Friday, July 10th, 2009hi i am wanting to know if the old house i shared with my ex partner will be repossed,we bought the house and it is a joint morgage,i had to leave him 6 months ago as he was phyically and mentally abusive towards me and my sons,i left and am currently renting a house at the moment.i have found out that my ex parner has not been making the monthy instalments for the morgage (he payed all the morgage even when i was there as i was a full time mum) so i think he has not payed for 6 months now,will the house be repossed? also he took a loan out that would only be given to him if he was a home owner,obviously i had to sign the loan sheet aswell as my name is on the morgage,if the house is repossed will they also take the loan repayments from the repossetion? i just want shut of the house and hope that it is repossed,i dont want any profits from it what so ever,i just want to be free from the morgage that we had toghether,how after not making payments will they put the repossetion in place? and does anyone know if i can still get my name taken off the morgage at this late stage? or will they not let me sign the morgage over to my ex partner as he has not been making the monthly payments,somebody please help me with this matter.thankyou x
how long after payments being made will the repossetion take place?
sorry i mean how long does it take them to put the repossetion in place after no payments have been made,as it has now been 6 months since the last payment was made.
will they also send bayliffs round before they will do a repossetion to try and get the money back? or do they just automatically reposses? how does the repossestion work? are there any fees? or attend court? i have absolutly no idea as you have probably guessed!! :/
CAN I STILL GET MY NAME TAKEN OFF THE MORGAGE???? this would be the easier option,i just want shut of it,should i go to the citizens advice,are they confidential? can they stricytky not tell any other company etc of my worries?
He probably has already be given notice by the bank and the sheriffs department.
I’m in a divorce situation right now and my soon to be x last made a payment in February. On the first we’ll be 7 months behind. We’ve had notice for over 2 months and the house will be sold at auction in mid October at the county court house, then I’ll have one day to vacate.
We had a notice posted on our door last week, but had letters sent along time ago.
He made the decision to go in to foreclosure, we have over 200k in equity and we could lose it. All the penalties, etc…
If you jointly own the house, you should have been served, too. Contact the bank/lender.
Also, depending on the type of loan, you still might be liable for the amount even if the bank takes it back, they are changing the laws because the banks are getting screwed.

Can u tell me what I need to do when I inherited my parents home?
Friday, July 3rd, 2009My parents died just two weeks apart. I am the heir on the house deed. There is no mortgage payment, my parents owned the house. What can I expect? Is there a fee for getting the deed in my name? I know I pay yearly taxes, but are there additional taxes since I acquired the home due to death of parents? I have student loans, and a little debt (repossed vehicle about 5 yrs ago, and a couple of credits). I am really worried about them student loans..Can they put a lien against my house? Should I put the house in someone elses name? What if I put it in my childs name she is 4. I dont trust her father, we have been together for 16 yrs BUT you never know..I realize the smartest thing to probably do is get my student loans back in good standing and start making monthly payments. BUT damn, is there a way around this? Is there anything else I need to b aware of?
Don’t put any house in the name of a minor…ever. Because we never know how our kids will turn out…if you do, and if your kid turns 18 and gets an attitude, they own the house and can sell it or even kick you out of it…and there isn’t jack you can do about it.
Her father has no claim to the house….it’s your parents, not his.
You need to contact a local attorney to find out what the probate system in your state is…which is usually a year. At that time, the proeprty will become yours, ASSUMING you have no other siblings.
No, there is no way around it.
In many, many years of working with loans and real estate and thousands of credit reports/title work, I have NEVER seen a defaulted student loan on a house…however, you can never bankrupt them..so you HAVE to pay them.
