How To Do a Short Sale
Why Would a Lender Accept a Short Sale?

A short sale in real estate is not always a pleasant transaction.

There are many ways to lose a home but signing away ownership in a manner that destroys credit, embarrasses the family and strips an owner of dignity is one of the hardest. For owners who can no longer afford to keep mortgage payments current, there are alternatives to bankruptcy or foreclosure proceedings. One of those options is called a “short sale.”

More than half of my sales in Sacramento over the past few years are short sales. That’s how prominent short sales have become.

When lenders agree to do a short sale in real estate, it means the lender is accepting less than the total amount due. Not all lenders will accept short sales or discounted payoffs, especially if it would make more financial sense to foreclose; moreover, not all sellers nor all properties qualify for short sales.

If you are considering buying a short sale, there could be drawbacks. For your protection, I suggest that all borrowers:

* Obtain legal advice from a competent real estate lawyer
* Call an accountant to discuss short sale tax ramifications

As a real estate agent, I am not licensed as a lawyer nor a CPA and cannot advise on those consequences. Except for certain conditions pursuant to the Mortgage Forgiveness Debt Relief Act of 2007, be aware the I.R.S. could consider debt forgiveness as income, and there is no guarantee that a lender who accepts a short sale will not legally pursue a borrower for the difference between the amount owed and the amount paid. In some states, this amount is known as a deficiency. A lawyer can determine whether your loan qualifies for a deficiency judgment or claim.

This call happened 4/24/09 whereas a Countrywide representative called me, Jason Werner, literally while I was driving home from a pre-mediation conference. The loan amount is less than $50,000. USPS to cost tax payers close to 3 billion as opposed to last year over 5 billion!

I know you don’t enjoy paying more for stamps when it seems the service is going down and the price of delivery just gets higher not to mention some customers talk about postal workers “sending messages” to unhappy customers for instance sending back mail, some customers, me included, customers so “unhappy’ with the USPS, we do not step foot in a post office is possible and prefer not to use the USPS but Fed Ex, hand delivery, anything else and WHY? WHY are people so unhappy that we feel that way to the tune of multi-billion dollars a year losses reported by the USPS?

Where did the term “going postal” come from?

There stories of unhappy customers are unending and the United States Postal Service wants to say billion dollar losses are due to email! Note: New Yorkers know that postal workers come right on to our property, it is not like having a postal worker drive up in a vehicle and put mail in your mail box so imagine what it is like to have something go very very wrong on your property with someone who has access to your mail box, your supposedly private information and knows where you live but you have no information about them and you prefer not to but just walk in and out of your home of 20 years with peace and quiet.

Do you have to be afraid of retaliation if you speak up? Here is my opinion and it is based on my experiences. Yes,be afraid. My beloved Gramps born on Ludlow was a mail man. He delivered mail in the Bronx. I love my Grandfather may he rest in PEACE but the illegal air sale over St. Ann’s, 120 East 12th Street so NYU could tear down St. Ann’s asap to supersize and build yet another NYU hideous mega dorm, the air sale by the USPS to NYU next door to me, and walking out every day seeing the fire hydrant blocked and circumstances so frightening I stopped having mail delivered to my home of 20 years last Decemeber are reason I don’t use the USPS but I don’t even cover why I like many others believe the USPS are not customer service oriented by the other extreme!!!!!

Am I surprised at the multi-billion dollar loses each year that tax payers have to absorb? No. Based on my observations and experiences I am not surprised last year the USPS lost over 5 billion dollars.

Federal Express runs a successful business that is friendly and they understand the words customer service so why can’t the USPS. The first step would be removing the USPS’s federal status and than next is that they run a profitable business rather than be bailed out by the U.S. tax payers every year to the tune of multi-billons.

Home Delivery: Fabricating the Modern Dwelling is both a survey of the past, present and future of the prefabricated home and a building project on the Museum’s vacant west lot. Not since the mid-century House in the Garden series has MoMA built occupiable model buildings to demonstrate contemporary issues to the public. The fives homes erected on the vacant west lot are designed by Kieran Timberlake Associates (Philadelphia); Jeremy Edmiston and Douglas Gauthier (New York); Horden Cherry Lee Architects / Haack + Höpfner Architects (London/Munich); Massachusetts Institute of Technology School of Architecture and Planning / Associate Professor Lawrence Sass (Cambridge); and Oskar Leo Kaufmann (Dornbirn, Austria).

The exhibition, and its accompanying Web site (www.moma.org/homedelivery), display the process of architectural design and production in equal measure with the actual end result.
